Terms of Service

1. Who we are

These Terms of Service (“Terms”) govern your use of Ollive and any related services (collectively, the “Service”) operated by Ollive (“we”, “us” or “our”). By creating an account or subscribing, you agree to be bound by these Terms and our Privacy Policy.

2. The Service

Ollive is a subscription service that delivers one human-made original illustration per month to subscribers. Illustrations are selected from a curated pool produced by independent artists. You do not choose the specific illustration you receive; each delivery is a surprise based on the monthly curated cycle.

A free (“Starter”) account lets you browse past shipments, discover illustrators, and become eligible for occasional gift drops. A paid (“Monthly Collector”) subscription entitles you to one physical illustration shipment per billing cycle.

3. Eligibility and account

You must be at least 18 years old to create an account or subscribe. By registering, you confirm that the information you provide is accurate and complete. You are responsible for maintaining the security of your credentials and for all activities that occur under your account.

4. Subscription, billing and renewal

The Monthly Collector plan is billed at €14.99 per month (VAT included). Your subscription renews automatically at the start of each billing cycle unless you cancel before the renewal date.

Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on each renewal date. All prices are shown in euros (€) and include applicable VAT.

We reserve the right to change pricing with at least 30 days’ prior notice sent to your registered email address. You may cancel before the new price takes effect.

5. Right of withdrawal

If you are a consumer resident in the European Union, you have the right to withdraw from a subscription contract within 14 calendar days of the date of purchase, without giving any reason (Directive 2011/83/EU). To exercise this right, send a clear statement to hello@ollive.art before the withdrawal period expires.

If shipment has already been dispatched during the withdrawal period, you may return the illustration in its original condition within 14 days of receipt. Return shipping costs are borne by you unless the item was faulty or incorrectly sent.

Refunds for valid withdrawals are issued within 14 days of us receiving the returned item or proof of return, using the same payment method as the original transaction.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will continue to have access to subscriber benefits until that date and will not be charged for the next cycle.

We do not offer partial-month refunds for cancellations mid-cycle, except where required by applicable law or in the case of a valid right-of-withdrawal exercise.

7. Delivery and risk

Illustrations are shipped to the address you provide in your account. You are responsible for keeping your shipping address accurate. We ship within the European Union; contact us at hello@ollive.art to enquire about international deliveries.

Risk of loss passes to you upon delivery to the carrier. If a shipment is lost or arrives damaged, contact us within 14 days of the expected delivery date and we will work to resolve the issue.

8. Intellectual property

Physical ownership of the illustration transfers to you upon delivery. However, copyright in the artwork remains with the original illustrator. You may display the work privately but may not reproduce, distribute, or commercialise it without the illustrator’s written permission.

All other content on the Ollive platform — including branding, design, text, and software — is owned by or licensed to us and may not be used without our prior written consent.

9. Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid us in the three months preceding the event giving rise to the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under mandatory EU consumer law.

10. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days in advance. Continued use of the Service after the effective date of revised Terms constitutes acceptance.

11. Governing law and disputes

These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer-protection provisions of your country of residence. As a consumer in the EU, you may also be protected by local mandatory consumer laws that cannot be derogated.
